Terms of Service

These Terms of Service ('Terms') govern your access to and use of the Timeko point of sale platform, including the POS terminal, admin dashboard, employee portal, and related services (collectively, the 'Service'), operated by Timeko ('we', 'us', or 'our'). By creating an account or using the Service, you agree to these Terms.
1. Agreement to Terms
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of the Service
Timeko is a point of sale platform for fast-food restaurants. The Service includes a touch-friendly POS terminal that works offline, an admin dashboard for managing stores, products, employees, schedules, and payroll, and an employee portal for viewing schedules and pay.
Features may change over time as we improve the Service. We may add, modify, or remove features at our discretion.
3. Accounts and Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials, including employee PINs, and for all activity that occurs under your account.
You agree to provide accurate information when registering and to notify us promptly of any unauthorized use of your account.
4. Acceptable Use
You agree not to misuse the Service, including: attempting to access accounts you do not own, interfering with the operation of the Service, using the Service to violate any law, or reselling the Service without our written consent.
5. Fees and Payment
Some features of the Service are free; others require payment of a subscription fee. Fees are billed in advance on a monthly basis and are non-refundable except as required by law.
We may change fees with reasonable notice. If you fail to pay, we may suspend your access to paid features until payment is received.
6. Intellectual Property
The Service, including its software, design, and content, is owned by Timeko and protected by intellectual property laws. You retain ownership of the data you enter into the Service.
We grant you a limited, non-exclusive, non-transferable license to use the Service for your business, subject to these Terms.
7. Your Data
You own the data you enter into the Service, including products, sales, schedules, and employee records. We process your data to provide the Service, as described in our Privacy Policy.
You are responsible for ensuring you have the right to store employee data and for complying with applicable laws regarding that data.
8. Offline Use and Data Sync
The POS terminal is designed to work offline. Data entered while offline is stored on your device and synced to our servers when you reconnect.
You are responsible for maintaining your devices and internet connection. We are not liable for data loss caused by device failure or failure to sync.
9. Third-Party Services
The Service may integrate with third-party services, such as payment processors. Your use of those services is subject to their own terms and policies.
We are not responsible for the availability or performance of third-party services.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms.
Upon termination, you may export your data for a reasonable period, after which it may be deleted in accordance with our Privacy Policy.
11. Disclaimers
The Service is provided 'as is' and 'as available' without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your specific business needs.
12. Limitation of Liability
To the maximum extent permitted by law, Timeko shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.
Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
13. Indemnification
You agree to indemnify and hold Timeko harmless from any claims, damages, and expenses arising out of your use of the Service or your violation of these Terms.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page.
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of the Philippines.
